For the provision of services, LEGACY VALLARTA REALTY will be able to:

  • Evaluate and accept the real estate representation service that the data holder has requested for the sale and/or lease of their property and to provide information regarding possible changes to that service.
  • Promote the property in print, electronic, and/or multimedia formats, as well as on real estate exchanges (e.g., Multiple Listing Services), publications owned and/or used by us, and others related to the sale and/or lease of the property.
  • Integrate personal data into professional real estate brokerage service contracts, private contracts of promise of sale or sale, purchase offers, as well as any other document required for the provision of the real estate brokerage service in accordance with applicable legislation.
  • Provide personal data to third parties with whom we have contracted services for data processing or on platforms and services for real estate development.
  • Transfer essential personal data to third parties, such as related companies, subsidiaries, financial companies, lawyers, notaries, authorities, or other third parties related to LEGACY VALLARTA REALTY. This is done only for the activity or service that those third parties carry out and is necessary for the real estate transaction. In accordance with the LFPDPP and due to the nature of our activity, LEGACY VALLARTA REALTY does not require sensitive personal data from our clients. However, if required, we will treat it in the terms of the LFPDPP.

To carry out the promotion of a property for professional real estate brokerage services, we may use audiovisual or photographic means of the properties or developments. In the case of property sales, the actual sale price may be used for statistical purposes.

The personal data of the client, as well as the information for the promotion and sale of the property, collected by the intermediary, its attendants, or authorized third parties, will be used to fulfill the purposes of this contract and for databases used for statistical information and market analysis, such as those of Vallarta-Nayarit FlexMLS. The client authorizes the intermediary to record the transaction value, deed, and characteristics of the property for said statistical purposes. The intermediary will maintain confidentiality with respect to personal data, in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP). The delivery, sending of documentation, and/or sharing of information or the client’s personal data implies the client’s consent for its collection, storage, and disclosure, as well as the client’s conformity with the Privacy Notice displayed on the website legacyvallartarealty.com.

Options and Means to Limit the Use and Dissemination of Personal Data

LEGACY VALLARTA REALTY has established administrative, physical, and technological security measures that allow personal data to be protected against damage, loss, alteration, destruction, or unauthorized use, access, or treatment. Its illegal disclosure is prohibited, and its use is limited to third parties, thus giving full compliance with the LFPDPP. Resources to Exercise ARCO Rights

For the exercise of Access, Rectification, Cancellation, or Opposition rights (ARCO) regarding the personal data provided, the data holder must send a request to info@legacyvallartarealty.com and must include the following elements:

  • Attach a copy of a valid official identification;
  • Describe in a timely manner the personal data and the object of the request;
